Dear Client: In a last ditch effort to utilize the controversial Robinson-Patman Act (RPA) to go after beverage companies (see Southern BBD 12-12-2024), the Federal Trade Commission's Lina Khan filed a lawsuit against PepsiCo on Thursday, accusing the company of illegal price discrimination practices that allegedly harmed both consumers and competition in the retail landscape.
