Walmart Challenges Constitutionality of TX Public Corporation Ban, Again

Dear Client: Walmart refuses to give up on its fight to sell spirits in Texas. After losing its bid before the Supreme Court and then voluntarily dismissing its lawsuit against the Texas Alcoholic Beverage Commission earlier this year, the retailer filed a petition this week in State District Court, challenging the TABC's public corporation ban on obtaining a package store permit.   BACKGROUND. Walmart can sell beer and wine in Texas, but is prohibited from owning a package store permit, and
