Sazerac Responds to KDA’s Lawsuit

Dear Client: You may recall that the Kentucky Distillers' Association (KDA) filed a lawsuit against Sazerac Company in a U.S. District Court in Louisville, Kentucky in May. The suit claims two of Sazerac's distilleries, Buffalo Trace and Tom Moore, are violating KDA's trademarked phrase "Kentucky Bourbon Trail," which is used in logo designs and promotional materials. The disagreement started in the summer of 2009 when Sazerac applied for a trademark of the phrases "Buffalo Trace Distillery on the Bourbon Trail"
