Round Two: The Latest on “To Kalon” Trademark Dispute

Dear Client: Earlier this year, Napa-based The Vineyard House reignited the dispute over the "To Kalon" trademark, filing suit against Constellation Brands, who owns the trademark. A judge dismissed the suit, but TVH filed an amended complaint and more recently a preliminary injunction against Constellation's use of newly-created "To Kalon Vineyard Company" brand. BACKGROUND. In March, The Vineyard House (TVH) filed suit against Constellation, hoping to strike down Constellation's existing To Kalon trademark and obtain the right to use the name themselves.
