Judge Rules Against KY Law Forbidding Wine and Spirits in Grocery Stores

Dear Client: US District Court Judge John Heyburn issued an order yesterday declaring a long-standing law in Kentucky, which forbids certain groceries and gas stations from selling wine and spirits, unconstitutional under the Equal Protections Clause. Under the law, drugstores can sell wine and spirits, but grocery stores and gas stations cannot. In his opinion the judge addressed all of the state's arguments in favor of the law with his primary disagreement being that drugstores and grocery stores don't differ
