Judge Dismisses “To Kalon” Case, but Leaves Room to Amend

Dear Client:Last week, a US District Court sided with Constellation Brands in the "To Kalon" trademark lawsuit brought against it earlier this year, dismissing the lawsuit, but leaving it open for an amended complaint.  QUICK RECAP. In March, Napa-based The Vineyard House (TVH) filed suit against Constellation, hoping to strike down its existing To Kalon trademark and obtain the right to use the name themselves. In fact, TVH claims that "all those who own land that was part of the original
