Gallo and Proximo Spar over New Tequila

Dear Client: E&J Gallo has filed a complaint in the Eastern District of California against Proximo Spirits who has accused Gallo of fashioning the design of its new tequila, Familia Camarena, "confusingly similar" to Proximo's 1800 Tequila. (Recall that Gallo also has a brandy and gin). In February 2010 Proximo allegedly sent a cease and desist letter through one of its Mexican affiliates to Gallo's supplier in Mexico, Tequila Supremo.
