Beam and SFIC Continue to Rumble over Cooley Contract

Dear Client: You may recall in March Sidney Frank Importing Co. (SFIC) filed a lawsuit against Beam and Cooley Distillery in New York's Southern District Federal District Court, making quite a few national news headlines (see WSD 03-04-2013 ). We reported on SFIC's initial complaint claiming breach of contract, unfair competition and tortious interference, but there has been some new and interesting developments in the case worth hashing out. BACKGROUND: SFIC spent $14 million on promoting, marketing and advertising its
