Magic Hat’s Painfully Public Infringement Battle

Dear Client: Since Magic Hat filed suit last week in the Eastern District of Kentucky against Lexington, Kentucky-based West Sixth for trademark and trade dress infringement, a social media-fueled public battle has ensued. West Sixth has taken to its Facebook page to relay its version of events to fans, which has so far gained them some 15,000 petition signatures and countless promises from fans to boycott the Magic Hat brand, including one from the Lexington Mellow Mushroom to take Magic
