Online Retailers File to Rehear Texas

Dear Client: If you thought they were going to give up easily, think again. The online wine retailers who a few weeks ago lost their case in the Fifth Circuit Court in Texas -- which said online retailers couldn't ship directly to Texas residents -- are trying to get the Fifth Circuit to rehear arguments in the case en banc, which means they want the entire Fifth Circuit bench to hear arguments (see BBD 01/27/10).
