BA to DOJ: Franchise Laws, 3-Tier Mandates Preclude Competition in Beer

Dear Client:  The Brewers Association has heeded the Department of Justice’s call to provide information on state laws that businesses claim preclude competition in the U.S. economy or interstate commerce. Specifically, they call out franchise laws and 3-tier mandates, among other common rules governing the U.S. beer industry.  It is the latest in the BA’s attempts to stymy franchise laws, as we saw in a previous attempt via comments submitted during Biden’s 2021 Executive Order on Promoting Competition. (Recall, they
