Texas’ “Bizzaro” Landmark Decision

Three-tier takes a strange direction. If I had to describe in two sentences what this ruling means in Texas, here it is: Texas bev-alc laws dealing with bans on out-of-state retailers shipping to Texas consumers, retailer residency requirements, and recently passed in-county limitations on all retailer shipping, are all unconstitutional and therefore null and void. Therefore, it is now legal for out-of-state retailers to apply for alcohol beverage retail licenses at the TABC - of course, as everybody knows, all TABC-licensed retailers are required by law to purchase their beer, wine, and spirits from licensed Texas wholesalers in good standing. And that stands.
